Antitrust Monitoring of Cargill, Wayne-Sanderson, and George's
Antitrust Compliance Monitors' Website and Intake Portal
This is the website of the Monitors appointed by Judge Stephanie A. Gallagher of the United States District Court for the District of Maryland.
On June 5, 2023, the United States District Court for the District of Maryland entered a Final Judgment in the form of a consent decree between the United States Department of Justice (“DOJ”) and the four Settling Defendants, Cargill Inc., Cargill Meat Solutions Corp. (collectively, “Cargill”), Wayne Farms, LLC and Sanderson Farms, Inc. (now “Wayne-Sanderson”). On August 22, 2023, the same court entered a separate Modified Final Judgment in the form of a consent decree between the DOJ and George’s Inc. and George’s Foods, LLC (collectively, “George’s”).
The Modified Final Judgments each require the Court to appoint a monitor selected by the United States and approved by the Court. The United States selected Dylan Carson, Partner at Manatt, Phelps & Phillips, LLC as Lead Monitor in this matter, and William Berlin, Shareholder at Hall, Render, Killian, Heath & Lyman, P.C. as Mr. Carson’s Deputy Monitor.
Mr. Carson and Mr. Berlin are charged with investigating and reporting on Cargill, Wayne-Sanderson, and George’s (1) compliance with the terms of Final Judgments entered by the Court, and (2) compliance with the U.S. federal antitrust laws relating to Poultry Processing, Poultry Processing Workers, Growers, integrated Poultry feed, hatcheries, the transportation of Poultry and Poultry products, and the sale of Poultry and Poultry Processing products, as those terms are defined in the Final Judgments and explained on this website.
